1. Acceptance of Terms
By accessing or using the Shaffer Groundworks website (“Site”) or client portal, you agree to be bound by these Terms of Service. If you do not agree, do not use the Site.
2. Services
Shaffer Groundworks provides landscaping and groundwork services as described on this Site. Quotes and estimates provided online or in person are subject to on-site assessment and may be adjusted based on actual conditions. No work begins without written or electronic authorization from the customer.
3. Client Portal
Access to the client portal is provided to registered customers. You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately if you suspect unauthorized access to your account. We are not liable for losses arising from unauthorized use of your account.
4. Payments
Invoices are due as specified on the invoice. Online payments are processed via Stripe. Late payments may be subject to a late fee as noted on the invoice. Disputed charges must be communicated in writing within 14 days of the invoice date.
5. User-Submitted Content
By submitting testimonials, reviews, or photos through our Site or portal, you grant Shaffer Groundworks a non-exclusive, royalty-free license to display and use that content for marketing purposes. You represent that you own or have the right to submit such content and that it does not violate any third-party rights.
6. Project Photos
We may photograph completed projects for portfolio and marketing use. Identifiable personal information (such as house numbers or full addresses) will not be published without explicit consent. Customers may opt out by notifying us in writing before project completion.
7. Limitation of Liability
To the fullest extent permitted by law, Shaffer Groundworks shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of this Site or our services. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.
8. Intellectual Property
All content on this Site — including text, images, logos, and design — is owned by or licensed to Shaffer Groundworks and may not be reproduced without written permission.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Updated terms will be posted with a new effective date. Continued use of the Site after changes constitutes acceptance.
10. Governing Law
These Terms are governed by the laws of the state in which Shaffer Groundworks is registered, without regard to conflict of law principles.
